What you're agreeing to

This agreement covers Figma's free/Starter and Professional plans (Organization/Enterprise customers use a separate contract). By using the service you agree to binding individual arbitration for almost any dispute and give up your right to a jury trial or to join a class action — though you can opt out within 30 days of first agreeing. You keep ownership of your own design files ('Customer Content'), but Figma can use that content to operate, secure, and support the service, and can also collect and permanently use de-identified 'Usage Data' about how you use the product. Any feedback you give Figma becomes theirs to use freely.

On the business side, subscriptions auto-renew, fees are non-refundable, and Figma can raise prices or change features/discontinue services at will (with limited refund protections). Figma can suspend or terminate your account at its 'sole discretion... without notice or liability' in most cases, though it will refund unused prepaid fees if the termination wasn't your fault, and gives you 30 days to export your content afterward.

Legally, Figma's liability to you is capped at the greater of $100 or your last 12 months of fees, and it disclaims responsibility for indirect damages like lost profits or data. You, on the other hand, must indemnify Figma for claims related to your content or your violations of the terms — there's no matching promise from Figma to indemnify you. Overall, this is a typical, business-favorable SaaS contract rather than an outright predatory one, but several provisions clearly favor Figma over the customer.
